These Terms of Service ("Terms") govern your use of Vybe Cabs (OPC) Private Limited ("Vybe Cabs") services, including those accessed through our websites and mobile applications (collectively, the "Platform").
Vybe Cabs provides a technology platform that connects customers ("Users") with independent third-party transportation providers ("Drivers") who offer transportation services. We are not a transportation provider and do not own, operate or control the vehicles or employ the Drivers.

User Accountability

To use the Services, customers must create a user account. Users also agree to provide accurate, current and complete information about themselves when creating an account and
When using our Services, User agree to comply with all applicable laws and these Terms are not to :
a) Harass, abuse or harm another person;
b) Transmit any content that is illegal, offensive, or otherwise objectionable;
c) Interfere with or disrupt the Services or servers or networks connected to the Services;
d) Attempt to gain unauthorized access to our systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Services.
Failure to comply with this User Conduct clause may result in the suspension or termination of your access to the Services.
The fees for our Services are set forth on our website or within the application. Fees that are subjected to refund needs to be adhered with our refund policy refundable.

Modification and Termination

Vybe Cabs reserve the right to modify these Terms at any time. If we do so, we will post the revised Terms on this page and indicate the date of the last revision. User continued use of our Services after any such changes constitutes your acceptance of the new Terms.
Vybe Cabs reserve the right to suspend or terminate your access to the Services at any time for any reason, including if we reasonably believe User have violated these Terms. User may also delete your account at any time. We reserve the right to maintain copies of information related to you.

Disclaimer

Vybe Cabs provides its services in their present condition and subject to availability. Vybe Cabs disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Vybe Cabs does not warrant that the Services will be uninterrupted, timely, secure, or error-free. Vybe Cabs does not guarantee the quality, suitability, safety, or ability of independent third-party transportation providers. Users agree that your use of the Services is solely at your own risk.

Limitation of Liability

To the maximum extent permitted by applicable law, Vybe Cabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from: (i) User access to or use of, or inability to access or use, the Services; (ii) the conduct or content of other users or independent third parties on or through the Services; (iii) unauthorized access, use, or alteration of User content.

Indemnity

User agree to indemnify and hold Vybe Cabs, its affiliates, directors, officers, employees, and agents harmless from any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising from your use of the Services, any violation of these Terms, any infringement of third-party rights (including intellectual property, publicity, confidentiality, property, or privacy rights), and any claims that User use of the Services caused damage to a third party.

Terms and Condition for Customer taking the Ride

a) Requesting Rides
Through the Vybe Cabs platform, User may request transportation services provided by independent third-party Drivers ("Drivers"). When you request a ride, User are authorizing us to facilitate the arrangement of transportation services between you and available Drivers.

b) Booking Rides
Once User have requested a ride, we will attempt to match your request with an available Driver. If a Driver accepts User ride request, we will provide you with information about the Driver and the vehicle. You must be ready and available at the pickup location at the scheduled time. If you fail to timely arrive at the pickup location, the Driver may cancel the ride, and you may be charged a fee.

c) Verification of Booked Ride Details
Before taking booked ride through our Services, User are requested for verifying the Driver and vehicle matches the details provided in the ride booking through our app. This includes confirming the Driver's identity, license, and the license plate.
If there are any discrepancies between the booked ride details and the actual Driver or vehicle used, User must take the ride and report this to Vybe Cabs immediately. Failure to verify the ride details and notify us of these issues, will not have any obligation or responsibility to investigate or address any complaints, disputes or conflicts that may arise.
Users acknowledge that the transportation services User receive are provided by independent third-party Drivers, not Vybe Cabs. While we collaborate with these Drivers, we do not have direct control over their actions or the vehicles they use.

d) Cancellations and Changes
User may cancel a ride booking at any time prior to the Driver's arrival, but cancellation fees may apply depending on when the cancellation occurs. Changes to ride details, such as pickup location, may also result in additional fees.

e) Payment
All ride fares and any applicable fees will be charged to the payment method you have provided and have on file with Vybe Cabs. Users are responsible for the full amount of each ride, including any cancellation or other fees.

Terms and condition for drivers and bikers

These Terms of Service ("Terms") govern Driver and Bikers use of Vybe Cabs (OPC) Private Limited ("Vybe Cabs") service, including those accessed through our websites and mobile applications (hereafter referred as the "Platform").
Vybe Cabs provides a technology platform that connects customers with independent third-party transportation providers "Drivers" “Bikers” who offer ride hailing and porter services. We are not a transportation provider and do not own, operate or control the vehicles or employ the Drivers or Bikers.

Terms and Conditions

Eligibility for Drivers
To drive for Vybe Cabs, drivers must meet specific eligibility criteria. This includes having a minimum of 2 years of driving experience, possessing a valid driver's license, and holding all necessary permits. A clean background check is essential, with no pending legal proceedings or convictions for specific offenses within the past 3 years. Additionally, drivers must not have any outstanding traffic fines. During the registration process, it is crucial to provide accurate information and promptly submit any additional required documents for verification. Failure to comply with these requirements may result in account suspension or termination.

Eligibility for Bikers

To be eligible to operate as a biker for Vybe Cabs OPC Private Limited, individuals must possess a minimum of 2 years of driving experience, hold a valid MCWG driving license and all necessary permits, and undergo a clean background check with no pending legal proceedings or convictions for specific offenses within the past 3 years. Additionally, bikers must not have any outstanding traffic fines. During the registration process, it is crucial to provide accurate and complete information, promptly submit any required documents for verification, and ensure compliance with local laws and regulations. Failure to meet these criteria may result in the suspension or termination of the biker’s account on the Vybe Cabs platform.

Porter Service-Specific Terms

1. Collection and Delivery
Bikers are responsible for collecting packages, documents, or goods from designated locations and delivering them to specified destinations in a timely manner. This includes ensuring that items are delivered in good condition.
2. Careful Handling of Goods
Bikers providing porter services must handle all goods with utmost care to prevent any damage during transport. It is essential that goods are securely fastened to the bike and that bikers adhere to weight limits set forth by Vybe Cabs OPC Private Limited or specified by the customer. Overloading or mishandling of goods is strictly prohibited to ensure safe and efficient delivery.
3. Timely Delivery
Bikers are required to deliver goods promptly, adhering to the scheduled pick-up and delivery times provided through the Vybe Cabs platform. In the event of any delays or issues that may affect timely delivery, bikers must immediately inform both Vybe Cabs and the customer to ensure transparency and manage situation effectively.
4. Prohibited Items
Bikers must not transport any illegal, hazardous, or otherwise prohibited goods as outlined by applicable local laws and regulations. Vybe Cabs reserves the right to check and verify the nature of the goods being transported to ensure compliance with legal standards and company policies.

Account Management

Drivers and Bikers are responsible for the management of their accounts on the Vybe Cabs platform. This includes registering and creating a Driver Account or Bikers Account with accurate information. It is essential to maintain the confidentiality of account credentials and to be accountable for all activities conducted under the account. Drivers and Bikers should promptly notify Vybe Cabs of any suspected unauthorized use and implement reasonable security measures to protect their account information. Communication from Vybe Cabs regarding platform use or service-related matters may occur through various channels, including electronic means, phone calls, WhatsApp, or email.
Service Operation
When operating on the Vybe Cabs platform, drivers and Bikers must adhere to specific guidelines and standards. They are required to accept ride or porter services requests exclusively through the platform interface; street hailing is not permitted. Bikers providing porter service must handle packages according to Vybe Cabs guidelines and refrain from tampering with or opening package. Professional conduct is paramount, requiring compliance with all applicable laws and regulations to maintain Vybe Cabs' reputation. Drivers and Bikers should minimize rejection of ride hailing service or porter service requests, as repeated denials may lead to account suspension or termination.
Behaviour and Substance Use
Drivers and Bikers must maintain a professional demeanor and abstain from drug or alcohol use before or during service provision. Vybe Cabs enforces a zero-tolerance policy regarding substance abuse. Also, they are required to use authorized and compatible devices to ensure system integrity. The platform should only be used for legitimate and service purposes, drivers and Bikers must avoid uploading or sharing harmful, offensive, or unlawful content.
Operational Limits and Training
Drivers and Bikers are subject to operational limits, which include a maximum of 12 hours of service per calendar day. Following this period, drivers must observe a mandatory 10-hour break before logging in again. Additionally, drivers and Bikers are required to complete mandatory training programs, including induction and refresher courses as specified by Vybe Cabs.

Standard of Duty for Drivers and Bikers

1. Punctuality and Adherence to Schedule
Drivers and bikers are required to ensure timely arrival at designated pick-up locations. In the event of any delays, drivers and bikers must promptly notify both the Company and the customer, providing an updated estimated time of arrival. All reasonable efforts must be made to avoid delays, and in cases where delays are unavoidable, clear communication with the Company and passengers is expected.
2. Vehicle Cleanliness and Presentation
All drivers and bikers must maintain their vehicles in a clean and presentable condition at all times, ensuring that both the interior and exterior meet the cleanliness standards set forth by Vybe Cabs. Regular inspections must be performed to confirm compliance with these standards. Failure to uphold cleanliness requirements may result in corrective action from the Company, which could include suspension.
3. Safety Compliance and Passenger Protection
Drivers and bikers are required to strictly adhere to all traffic laws, rules, and regulations while providing services under the Vybe Cabs platform. Passenger safety must be prioritized in all situations, and vehicles must be equipped with necessary safety features such as seatbelts and emergency supplies. Reckless driving or bike riding is strictly prohibited, and appropriate precautions must be taken to avoid accidents or incidents that could endanger passengers or the general public. Non-compliance may result in disciplinary action or termination.
4. Customer Service Standards
Both drivers and bikers are expected to provide superior customer service at all times. Passengers must be treated with courtesy, respect, and professionalism. Assistance should be offered when necessary. Sufficient knowledge of the local area, including roads, traffic patterns, and alternate routes, is essential to ensure efficient and timely travel.
5. Communication
Clear and professional communication must be maintained by drivers and bikers in all interactions with customer. The Vybe Cabs mobile application should be used for receiving updates, instructions, and notifications regarding ride and porter service management. Any failure to maintain open lines of communication or to follow instructions from the mobile application may lead to disciplinary action by the Company.
6. Behavioral Conduct
All drivers and bikers must adhere to behavioral guidelines while operating under the Vybe Cabs platform. Passengers are to be greeted politely, and assistance with luggage must be provided when needed. All passengers must be treated equitably, without discrimination based on race, gender, age, religion, or any other protected characteristic. Harassment, inappropriate comments, or actions are strictly prohibited. Privacy must be respected at all times, and the consumption of alcohol, drugs, or intoxicating substances is forbidden while on duty. Any misconduct that could harm the reputation of Vybe Cabs will not be tolerated and may lead to termination of the driver's or biker’ account.
7. Emergency Preparedness
Drivers and bikers must be prepared to handle emergencies that may arise during the provision of services. In the event of an accident, vehicle or bike breakdown, or medical emergency, immediate action must be taken to ensure passenger safety. Notification of the appropriate authorities and Vybe Cabs is required, and drivers and bikers must follow provided instructions for proper resolution of the issue.
8. Lost and Found
Any items left behind by customer must be reported immediately to Vybe Cabs’ lost and found department. Drivers and bikers are required to ensure that such items are returned to the Company without delay. Non-compliance with this obligation may lead to suspension or disciplinary action.

Prohibited Activities

Substance Abuse Policy
Drivers and bikers affiliated with Vybe Cabs are strictly prohibited from engaging in any activities that undermine the integrity and safety of the service. This includes substance abuse, harassment, and discrimination of any kind. The company maintains a zero-tolerance policy regarding these behaviors, ensuring a safe and respectful environment for all passengers and employees. Any driver or biker found to be under the influence of drugs or alcohol while on duty will face immediate disciplinary action, which may include suspension or termination of their account.
Harassment
Any form of harassment—whether verbal, physical, or emotional—toward passengers, colleagues, or other individuals is strictly forbidden, and violators will be held accountable for their actions as per the laws and regulation and would be further banned from working with Vybe cabs OPC Private limited.
Unauthorized Use of the Platform
Unauthorized use of the Vybe Cabs platform for illegal activities or personal transportation unrelated to the company’s services is expressly prohibited. This includes engaging in street hailing, transporting goods for non-Vybe Cabs customers, or participating in any illicit actions. Such activities not only violate company policies but can also result in serious legal repercussions for the individuals involved.
Safe Driving Practices
Reckless driving and bike riding neglecting customer safety are strictly prohibited. All drivers and bikers must operate their vehicles in a safe and responsible manner, adhering to all traffic laws and regulations. Prioritizing the safety of passengers and others on the road is paramount. Any incident of reckless driving or failure to ensure passenger safety will result in severe consequences, including potential termination of the driver’s or biker’s contract with Vybe Cabs.
Reporting Incidents and Misrepresentation
Furthermore, timely reporting of incidents, accidents, or emergencies is required. Drivers and bikers must notify Vybe Cabs immediately if any such occurrences arise. Failing to report incidents could hinder the company’s ability to respond effectively and may result in disciplinary action against the individual involved. Providing false or misleading information during the registration process or while using the Vybe Cabs platform is also not tolerated. Misrepresentation undermines the trust essential to the operation of the service and may lead to immediate termination of the driver’s or biker’s account.
Commitment to Integrity and Professionalism
Vybe Cabs is committed to fostering a safe, respectful, and professional environment. The company takes these prohibitions seriously and expects all drivers and bikers to uphold the highest standards of conduct in all interactions and activities associated with the platform. Violations of these policies will not be tolerated and will be met with appropriate consequences to maintain the integrity and reputation of Vybe Cabs
Disciplinary Action
Drivers and Bikers who engage in prohibited activities or fail to adhere to the Company’s policies, procedures, or Terms of Service will face immediate and appropriate disciplinary action. This may include suspension or termination of their Driver Account, Biker Account depending on the severity of the violation. Vybe Cabs maintains a strict stance on compliance to ensure the safety and satisfaction of all users on the platform.
In addition to internal disciplinary measures, Vybe Cabs reserves the right to take legal action if necessary to protect its interests and uphold the integrity of its services.

Termination

Vybe Cabs reserves the right to suspend or terminate the Driver or Bikers access to the Services or platform at any time, for valid and justified reasons, including but not limited to:
a) A reasonable belief that the Drivers or Biker has violated these Terms.
b) Engagement in unlawful or prohibited activities as described in these Terms.
c) Any activity that compromises the security or functionality of the platform.

Upon suspension or termination, Vybe Cabs reserves the right to maintain copies of Driver or Biker related information for record-keeping and compliance with legal obligations and laws.

Modification

Vybe Cabs reserves the right to modify or amend these Terms at any time at its sole discretion. In the event of any such modifications, the revised Terms will be posted on this page, with the date of the last revision clearly indicated. The Drivers and Bikers continued use of the Services or platform following the posting of any changes to these Terms constitutes acceptance of the new Terms.

Indemnity

Drivers and Bikers agree to indemnify and hold Vybe Cabs, its affiliates, directors, officers, employees, and agents harmless from any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising from use of the Services or Platform , any violation of these Terms, any infringement of third-party rights (including intellectual property, publicity, confidentiality, property, or privacy rights), and any claims that Driver or Bikers use of the Services caused damage to a third party.

Applicable Law

The duration and conditions of the services provided under this Term of Service, along with any disputes, disagreements, or claims that may arise in the future related to our services or platform shall be governed by and interpreted in accordance with the laws of India

Dispute Resolution

In the event of any disputes or disagreements related to the Terms of Service, the Driver or Bikers should first seek to resolve the issue through negotiation and discussion with Vybe Cabs' grievance redressal team.
If the matter remains unresolved after 30 (thirty) days of good-faith negotiations by the senior management of both Parties, the dispute will be submitted to binding arbitration. This arbitration will be conducted in accordance with the Indian Arbitration and Conciliation Act, 1996, including any subsequent amendments or modifications.
The arbitration will take place in Bengaluru, Karnataka, with the proceedings conducted in English. Both the Parties will mutually agree on the appointment of a single arbitrator to manage the arbitration process.
