This Privacy Policy (“Policy”) is established by Vybe Cabs OPC Private Limited (“we," "us," or "our") to describe the manner in which we collect, use, share and protect the data of an individual which they provide while using our platform and service. This Policy is formulated in accordance with the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

Vybe Cabs is committed to safeguarding the privacy and security of our Customers, Drivers, and Visitors (hereinafter referred as, "Users"). Data is collected during User's interaction with our Platforms and use of our service and processed strictly in accordance with the requirements of our services and applicable regulations and laws governing the Platforms.

Scope

This Policy applies to the data we collect, use, share, protect, and update through our platform. This Policy governs the data received by Vybe Cabs within India solely for the purpose of providing services to Users located in India.
Please note that we are not obligated to comply with regulations related to personal information that falls outside the scope of applicable law, including information that has been publicly disclosed by the User or someone legally obligated to disclose it.
This Privacy Policy is effective as of 01/09/2024 and governs our use of User data collected after this date.

Definition

Customer shall mean any person that’s visits the platform with the intention of availing our service.
Driver shall mean a mean an independent contractor who uses their vehicle to provide services to Customer through the Vybe Cabs Plattform.
User shall mean any Individual (customer, driver, visitors) that visit the platform and use the vybe cabs service.
Data: Data refers to any collection of facts, statistics, or information that can be processed or analyzed. At Vybe Cabs, data encompasses both personal and sensitive information collected from users for availing service or platform.
Service: Service shall mean ride hailing and porter service availed via Vybe Cabs platform.

Types of Data Collected

Personal data refers to any information that can identify an individual. The categories of personal data collected include account information such as user email address, full name, address, mobile number, gender, date of birth, and profile picture.
Sensitive data refers to confidential information that requires a higher level of protection due to its nature. The categories of sensitive data collected include location details, verification details such as Aadhaar card numbers, driver’s license details, and vehicle-related documents (including registration, permits, and insurance.)

Vybe Cabs respects User privacy and is committed to protecting User personal and sensitive data. We collect User data when they interact with our platform or avail our service including:
1. Registering for a Vybe Cabs account
2. Booking a ride
3. Booking a porter service
4. Contacting customer support

For Customers

The Account information includes Name, Phone Number, gender email id, city, Pin code, State, date of birth. Additionally, we may collect customer care support information, which pertains to any details customer provide during interactions with customer support, including queries, complaints, and requests for assistance.

For Drivers

The account information includes the name, phone number, gender, email id, city, pin code, State date of birth, and vehicle details. Additionally, for service and verification purposes, profile pictures, Aadhaar card, banking details, and vehicle-related documents (such as the driving license, vehicle insurance, and registration certificate) are collected.

For Customers
1. Trip Related Information:
We collect details about customer trips, including pick-up and drop-off locations, distance travelled. To ensure accurate fares, efficient routes, and improved service quality while maintaining records for safety and operational purposes.
2. Location Data:
We gather precise or approximate location data from the customer’s device when permission is granted. This data is collected from the moment the customer requests a service until it is completed, as well as whenever the app is in use. We utilize this information to enhance the customer experience, improve pick-up locations, enable safety features, and prevent fraud. Even if the customer does not permit us to collect their location data, we will still collect the driver's location data during trips and link it to the customer’s account to provide services and customer support.
3. Usage Information:
We, along with our third-party service providers, may automatically collect data about customer interactions with the Vybe Cabs platform, including browser type, the referring URL and usage behavior within the app.
4. Cookies:
Usage information may be collected using cookies. If customers prefer not to have information collected via cookies, they can adjust their browser or app settings. Disabling cookies may limit some features of the service. We cannot control the use of cookies by third parties, and such usage is not covered by our policy.

For Drivers
1. Trip Related Information:
We collect information related to drivers’ trips, including pick-up and drop-off addresses, distance travelled, and payment details, to ensure drivers fulfil their responsibilities to Vybe Cabs. This data is crucial for monitoring performance, managing driver duty, and maintaining service quality.
2. Location Data:
We collect location data whenever the Vybe Cabs app is active, whether in the foreground or background. For drivers, location data is gathered only when the “On-Duty” option is enabled in the app.

For Users
Device Information
We collect device-specific information from users to enhance their experience on the Vybe Cabs platform. This information may include device identifiers, such as the operating system identification, which helps us optimize our services for user and improve overall functionality.

SMS/Text Message
We may collect data to provide SMS/text messages and emails for the purposes of issuing and receiving One-Time Passwords (OTPs) to facilitate secure access to the Vybe Cabs platform, as well as for verifying devices to confirm their authenticity when accessing our services.
Please note that we do not share SMS/text message and emails data with any third parties.

Feedback and Support:
We gather user feedback, inquiries, and support requests to improve our services and address any issues or concerns users may have.

Additional Information:
We may also collect additional information related to user interactions with the Vybe Cabs platform, including the frequency of app usage, which helps us understand user retention and engagement levels. Vybe Cabs utilizes the information collected from Users to facilitate access to our Platform and ensure secure verification processes. We use User data to create and manage their account, allowing user to access our services and platform seamlessly. For Drivers, we verify their identities by analyzing submitted documentation and conducting background checks, ensuring that only qualified individuals provide services through our Platform. This verification process helps maintain a safe environment for all Users, enhancing trust and security in our transportation services.

2. Feature and Service Management
Vybe Cabs utilizes the data collected from Users to enhance our services through effective feature monitoring and initial communication. By analysing usage patterns, we can identify which features of our platform are most popular and actively used. This information allows Users to conveniently access their trip history, rate their trips and bookings, and helps us pinpoint areas that require improvement for a better user experience. Additionally, upon registration, we may send Users initial email or SMS to verify their username details ensuring a secure and smooth onboarding process. This initial communication not only confirms account creation but also establishes a reliable line of communication for future updates and notifications.

3. Communication and Announcements
Vybe Cabs is committed to keeping users informed by utilizing the data we collect for essential service announcements, notifications, and administrative updates. When necessary, we send strictly service-related communications, such as notifications about new features, services, or policy amendments, to ensure users are always aware of any changes that may affect their experience. These communications are primarily conducted via email.

B. Driver Geo-Location Services
For Drivers, geo-location services are essential for receiving orders promptly, enabling customer tracking, and sharing their location details to ensure a safe and efficient ride experience.
C. Tailored Coupons and Rewards
Additionally, we analyze user consumption patterns to provide tailored coupons and rewards. This approach ensures that our users receive personalized promotions in the form of coupons, enhancing their overall experience with the Vybe Cabs platform

6. Internal Use and Analytics
Vybe Cabs, utilizes the information collected from users for essential internal business operations, enhancing our services' effectiveness and efficiency. This includes performance analysis to monitor functionality, fix errors, and improve usability for an optimal user experience. Additionally, we may use User information for developing new features or conducting surveys to better understand user needs and preferences.

When We Share Your Data

Vybe Cabs is committed to protecting User privacy and shares their data only, when necessary, that is to provide our services and comply with legal requirements.

A. Facilitating Services

We may share User data with our affiliates, employees, and agents on a need-to-know basis to provide Vybe Cabs services effectively. To fulfill trip requests, we share customer data such as names and locations, phone number with designated Drivers. For Drivers, location data is only share when the "On-Duty" icon is activated.

We utilize geo-location information to assist customers in viewing nearby Drivers, automatically fetching their location data to enhance the overall user experience. This functionality not only helps in connecting customers with available Drivers but also plays a critical role in improving safety features during rides.
2. Driver Geo-location Services
For Drivers, geo-location services are essential for receiving trip requests promptly. These services enable efficient customer tracking and allow Drivers to share their location details, ensuring a safe and effective ride experience. By leveraging geo-location data, we aim to optimize the ride process for both customers and Drivers alike.

B. Third-Party Service Providers

at Vybe Cabs, we collaborate with various third-party service providers to support our operations effectively. These providers may have access to user data only to the extent necessary to perform their specific services, such as cloud storage, payment processing, or marketing. We strictly limit their use of user data to purposes directly related to providing services to Vybe Cabs. To enhance our service and improve User experience, we may share data with trusted third-party service providers who assist us in various operational functions, playing a crucial role in supporting our services across different areas.

C. Legal Disclosures

Vybe Cabs takes User privacy seriously and is dedicated to safeguarding their Data . We employ various security measures to protect User data, including storing their information on secure servers with OTP verification to prevent unauthorized access. Our employees are trained in data security best practices to handle User information responsibly. We conduct regular reviews and updates of our security measures to ensure they remain effective in protecting User data. Access to User data is restricted to authorized personnel only. These measures are in place to uphold the security and confidentiality of User data while they use Vybe Cabs services.

Data Retention

Vybe Cabs retains user personal and sensitive data for a maximum duration of three months to fulfil the purposes for which it was collected, in compliance with applicable laws and regulations. After this period, we will securely delete the data.

Protecting Children's Privacy

Vybe Cabs is committed to protecting the privacy of children. Our services are not directed towards children under 18, and we do not collect any data from children.

User Data Rights

At Vybe Cabs, we respect and uphold the rights of Users to access and control their data. We are committed to responding promptly to requests concerning personal and sensitive information, including the correction, amendment, or deletion of data when applicable.

1. Right to Access Information
Users have the right to request a summary of the data we hold about them at any time. Upon receiving such a request, we shall respond within 72 hours.

2. Right to Correct and Update Information
If any personal data held by us regarding a User is found to be outdated, incomplete, or incorrect, the User may notify us, and we shall promptly update the information accordingly.

3. Right to Delete Information
Users shall have the right to request the deletion of their accounts and all associated personal and sensitive data at any time:
a. Initiation of Deletion Request
To initiate the account deletion process, Users may submit a request via mailing us at legal@vybecabs.com
b. Deletion Process
Upon receipt of a duly submitted account deletion request, Vybe Cabs shall take the necessary steps to permanently delete the User’s account and all associated data from our systems expeditiously.
c. Clarification on Account Status
It is expressly clarified that temporary deactivation, disabling, or "freezing" of a User's account shall not constitute account deletion as contemplated herein.
d. Data Retention
Vybe Cabs retains the right to retain certain personal data where such retention is necessary for legitimate business purposes, including but not limited to compliance with applicable laws and regulations, fraud prevention, and security measures. In such instances, Users shall be duly informed of the specific data retention practices as delineated in this Privacy Policy.
e. Acknowledgment of Consequences
By submitting a request for account deletion, Users acknowledge and accept that they shall forfeit access to their account and all related services and features.
f. Data Retrieval
Users are advised to download or otherwise retrieve any data they deem necessary prior to initiating an account deletion request, as such deletion is irreversible upon completion.

4. Right to Withdraw Consent
Users have the right to withdraw their consent to data processing at any time, subject to applicable laws. Withdrawal of consent may be executed easily via email legal@vybecabs.com.

5. Right to Object to Processing
Users have the right to request that we cease processing their personal data where applicable. Upon receiving such a request, we will inform the user whether we can comply after evaluating whether there are legitimate grounds to continue processing the data.

6. Right to Lodge a Complaint: Users have right lodge a complaint via email by sending their concerns or issues directly to our designated email address.

Limitations

Vybe Cabs cannot be held responsible for any security breaches that occur during the internet transmission of data including unintended loss, misuse, alteration, or disclosure. Moreover, we are not liable for any loss, damage, or misuse of data resulting from events beyond our control (force majeure) or reasons attributable to you. We may disclose User data in good faith or as necessary to comply with legal obligations, or if required by law, court order, or statutory authority.

Privacy Policy Update

Vybe Cabs reserves the right to update its privacy policy to reflect changes in practices or legal requirements. Users will be notified of any significant changes via email. It is encouraged that Users periodically review the policy, and by continuing to use Vybe Cabs after an update, Users indicate their acceptance of the revised terms.
